The most important activities of Serbian Association for Criminal Law and Practice

Conference on the application of new Criminal Procedure Code took place at Zlatibor.

It is familiar that Serbia has been paying the compensations to the judges that were not elected and that is still covering the expenses of the judges who have to travel from one place to another due to the fact that some municipal courts have been closed. Vujic was not precise about his statement on the total amount of these expenses and whether they include only the compensations or other additional expenses as well.

When discussing whether the jurists who attended Judicial Academy would have any advantage when it comes to the election of new judges and prosecutors instead of those who did not attend that educational institution but have rich practical experience, Danilo Nikolic PhD, state secretary at Ministry of Justice and Public Administration said that there are around 1.729 assistants of judges and public prosecutors and that they need to be treated in the same manner as those who attended courses and trainings at Judicial Academy.

The value of the laws depends on the personal values of those who implement them. I think it will be very hard to implement Criminal Procedure Code in practice, said Professor Stanko Bejatovic, Full Professor at Faculty of Law, University of Kragujevac and the president of Serbian Association for Criminal Law and Practice, the organizer of the Conference.

Judge of Supreme Court of Cassation, judge Janko Lazarevic, pointed out that practical implementation of new Criminal Procedure Code will be followed by serious problems, particularly when it comes to the functioning of Public Prosecutors. However, he said that he believes that those who are in charge of implementing the law will find the way to overcome these obstacles. Police, Prosecutors and Judges need to accept this mission in the most serious manner and struggle to find solutions even in the situations when not so successful provisions of the Code need to be implemented.
